By accessing or using SpotMyLove (“the Service”), including purchasing a spot on the canvas, you agree to these Terms of Service.

If you do not agree with these Terms, please do not use the Service.

SpotMyLove is intended for users who are at least 18 years old.

By using the Service, you confirm that you are legally able to enter into binding agreements and comply with these Terms.

• SpotMyLove provides a public digital canvas where users can purchase and customize spots dedicated to people they care about.
• The canvas is publicly accessible and may be viewable worldwide.
• Spot placements, rankings, visibility, and presentation may vary depending on the selected tier and platform design.

Users are responsible for the content they submit to SpotMyLove.

All submissions are subject to moderation and review. We reserve the right to reject, edit, restrict, or remove content that violates our policies or may create legal, safety, operational, or reputational risks.

Prohibited content includes, but is not limited to:

• Hate speech or discriminatory content
• Harassment, threats, or abusive language
• Sexually explicit or exploitative material
• Illegal content
• Personal information shared without consent
• Spam, scams, or deceptive content
• Commercial advertising or unauthorized promotion
• Content that infringes intellectual property rights

Violation of these rules may result in content removal, account restrictions, or cancellation of services.

• When a purchase is completed, the selected spot is allocated to your submission and associated with your dedication on the canvas.
• Spot purchases are for digital services and customized digital content delivered through the SpotMyLove platform.
• You are responsible for reviewing your submission details carefully before completing payment.

Due to the customized and digital nature of SpotMyLove submissions, purchases are generally non-refundable once a spot has been allocated and content processing has begun.

However, we may review refund requests in limited situations, including:

• Duplicate transactions
• Technical errors
• Unauthorized payments
• Failed delivery of the purchased service
• Situations required by applicable law

Content removed for violations of our policies or moderation guidelines is not eligible for refund.

SpotMyLove is designed as a long-term public digital canvas experience.

• By submitting content, you understand that approved dedications may become publicly visible and may be indexed, shared, captured, or referenced by third parties.
• While we aim to maintain the platform and public canvas over time, we do not guarantee uninterrupted availability or permanent accessibility.
• We reserve the right to modify, maintain, discontinue, or evolve portions of the Service when necessary.

The SpotMyLove platform, branding, software, visual systems, and canvas design are owned by SpotMyLove or its licensors.

You retain ownership of the content you submit. However, by submitting content to SpotMyLove, you grant us a worldwide, non-exclusive license to host, display, reproduce, process, and present your submission as part of the Service.

We reserve the right to refuse transactions, suspend accounts, limit activity, or remove content where we reasonably suspect:

• Fraudulent activity
• Chargeback abuse
• Platform manipulation
• Automated abuse or spam
• Violations of payment processor policies
• Harmful or malicious behavior

We may cooperate with payment providers, regulators, or law enforcement where legally required.

To the maximum extent permitted by law, SpotMyLove shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Our total liability relating to any claim shall not exceed the amount paid for the specific purchase giving rise to the dispute.

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which SpotMyLove operates, without regard to conflict of law principles.

Any disputes arising from these Terms may be resolved through arbitration or other legally permitted dispute resolution procedures.

We may update these Terms from time to time.

Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
